Acceptance of these Terms
These Terms of Service form a binding agreement between you and SuperSurvey regarding your use of our websites, survey tools, and related services (together, the “Services”). By accessing or using the Services, creating an account, starting a trial, or purchasing a subscription, you agree to these Terms. If you do not agree, you must not use the Services.
These Terms apply across the domains and product experiences through which we provide SuperSurvey.
Accounts and eligibility
You may use SuperSurvey only if you are legally able to enter into a binding agreement with us and only if you comply with these Terms and applicable law.
Minimum requirements
You must be at least 18 years old, use a valid email address, and provide accurate account information.
Account responsibility
You are responsible for activity that occurs under your account and for keeping your login credentials secure.
Truthful use
You may not impersonate another person or entity, misrepresent your identity, or use misleading account details.
Shared access
You may not let unauthorized third parties access or use your account in a way that violates these Terms or your purchased plan.
Trials, subscriptions, billing, and taxes
SuperSurvey may offer free plans, paid plans, trials, promotions, and plan-based feature limits. We may change plan features, plan limits, pricing, packaging, or availability at any time.
Trials and conversion
If you start a free trial or promotional offer for a paid plan, the trial will convert to a paid subscription only under the pricing and billing terms presented to you at signup or checkout. It is your responsibility to cancel before the trial conversion or renewal date if you do not want to continue.
Billing
Paid subscriptions are billed monthly or annually, depending on the plan you choose at signup. By purchasing a paid subscription, you authorize us to charge the payment method you provide for recurring subscription fees, applicable taxes, and any other charges clearly disclosed during purchase.
Renewals
Unless otherwise stated at the time of purchase, paid subscriptions renew automatically for the same billing cycle until cancelled.
Taxes
You are responsible for any taxes, duties, levies, or similar government charges associated with your purchase, except taxes based on our income.
To avoid renewal charges, cancel before your next billing date. Cancelling after a charge has been processed does not automatically create a refund right.
Cancellation, access, and data after cancellation or non-payment
You may cancel your subscription at any time. Unless otherwise required by law, cancellation stops future renewals but does not reverse or prorate charges already paid for the current billing period.
What happens when you cancel
If you cancel a paid subscription, you will generally continue to have access to paid features until the end of your prepaid billing period, unless your account is suspended or terminated earlier under these Terms.
What happens if payment fails
If a renewal payment fails or your payment method can no longer be charged, we may suspend, restrict, downgrade, or terminate access to paid features, account management tools, exports, survey administration, responses, or historical data until payment is successfully resolved.
Data retention after cancellation, expiry, or failed payment
After cancellation, expiry, or failed payment, we may retain your account data and survey data for a limited period for operational, legal, security, backup, fraud-prevention, or compliance reasons. However, we do not guarantee that cancelled, expired, suspended, or unpaid accounts will remain accessible, recoverable, exportable, or restorable for any specific period of time.
It is your responsibility to export or retain any data you need before cancellation, the end of your paid term, or any payment failure. Subject to applicable law, we may permanently delete data from cancelled, expired, inactive, suspended, or unpaid accounts without further notice.
Refunds
Unless required by law, subscription fees and other charges are non-refundable. We may, in our sole discretion, consider refund requests on a case-by-case basis. Any decision to issue a refund in one instance does not create an obligation to issue refunds in the future.
If you believe you were charged in error, contact us through our Contact page as soon as possible and include the account details and charge information needed for us to review the request.
Acceptable use
You may not use the Services in a way that is unlawful, fraudulent, deceptive, abusive, or harmful to us, our users, respondents, systems, or third parties.
No unlawful or deceptive use
Do not use SuperSurvey to violate applicable law, infringe rights, impersonate others, or mislead respondents.
No platform abuse
Do not interfere with the operation, security, availability, or integrity of the Services, including by scraping, reverse engineering where prohibited, or attempting unauthorized access.
No harmful content or misuse
Do not use the Services to distribute malware, spam, fraudulent campaigns, or content that creates legal or operational risk for us or others.
Suspension and termination
We may suspend, restrict, or terminate access to the Services, with or without notice, if we reasonably believe that:
- you have violated these Terms;
- your use creates security, legal, reputational, or operational risk;
- payment is overdue or fails;
- we are required to do so by law, regulation, court order, or third-party service obligations; or
- continued service is no longer commercially, technically, or operationally feasible.
If your account is suspended or terminated, you may lose access to some or all content, responses, account tools, exports, and paid functionality. Subject to applicable law, we are not liable for any loss resulting from such suspension, restriction, or termination.
Disclaimers, warranties, and limitation of liability
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, SuperSurvey disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that the Services will be uninterrupted, error-free, secure, or available at all times, or that any data will never be lost, corrupted, delayed, or inaccessible.
To the maximum extent permitted by law, SuperSurvey and its affiliates, owners, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, use, data, or business opportunities arising out of or related to your use of the Services.
To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Services will not exceed the amount you paid us for the Services during the 12 months immediately before the event giving rise to the claim.
Changes to these Terms
We may update these Terms from time to time. When we do, we may revise the “Last reviewed” date on this page. Your continued use of the Services after an updated version becomes effective means you accept the revised Terms.
